Terms of service
- General
1.1. These terms and conditions ("Terms") apply to the sale of semi-cured gel nail wraps ("Products") by MANILAB ("Seller") to the purchaser ("Buyer").
1.2. By purchasing the Products from the Seller, the Buyer agrees to be bound by these Terms.
- Orders
2.1. The Buyer may place an order for Products by submitting an order through the Seller's website or by email.
2.2. The Seller may accept or reject the Buyer's order at its sole discretion. The Seller will communicate the acceptance or rejection of an order to the Buyer within a reasonable time.
- Price and Payment
3.1. The price of the Products will be as stated on the Seller's website or in a quotation provided by the Seller to the Buyer.
3.2. The Buyer must pay the full price for the Products at the time of placing the order.
3.3. Payment may be made by credit card, PayPal or any other method accepted by the Seller.
3.4. All prices are in Australian dollars (AUD), and the Seller reserves the right to change the prices at any time without prior notice.
- Delivery
4.1. The Seller will deliver the Products to the address specified by the Buyer in the order.
4.2. The delivery time will depend on the destination and shipping method selected by the Buyer. The Seller will communicate the estimated delivery time to the Buyer at the time of the order.
4.3. The Buyer is responsible for paying any taxes or customs duties that may be applicable to the delivery of the Products.
4.4. The risk of loss or damage to the Products will pass to the Buyer upon delivery.
- Returns and Refunds
5.1. The Buyer may return the Products to the Seller within 14 days of receipt if the Products are defective or do not conform to the description provided by the Seller.
5.2. The Seller will either replace the defective Products or refund the full price paid by the Buyer.
5.3. The Buyer must notify the Seller in writing of any defects or non-conformities within 14 days of receipt of the Products.
- Disclaimer of Warranty
6.1. The Seller makes no warranties or representations as to the performance or suitability of the Products for any particular purpose.
6.2. The Buyer acknowledges that the Products are provided "as is" and that the Seller disclaims all warranties, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6.3. The Seller does not warrant that the Products will meet the Buyer's requirements, that the operation of the Products will be uninterrupted or error-free, or that any defects in the Products will be corrected.
- Limitation of Liability
7.1. The Seller's liability to the Buyer for any claim arising out of the purchase or use of the Products, whether in contract, tort, or otherwise, is limited to the purchase price of the Products.
7.2. In no event will the Seller be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the purchase or use of the Products.
7.3. The Buyer acknowledges that the limitations of liability set forth in these Terms are reasonable and reflect the allocation of risk between the parties.
- Governing Law and Jurisdiction
8.1. These Terms and the purchase and use of the Products will be governed by the laws of Australia without giving effect to any principles of conflicts of law.
8.2. Any dispute arising out of or in connection with these Terms or the purchase or use of the Products will be resolved through good faith negotiation between the parties.
8.3. If the parties are unable to resolve a dispute through negotiation within 30 days, the dispute will be referred to mediation in accordance with the Australian Dispute Resolution Guidelines.
8.4. If the dispute is not resolved through mediation, either party may refer the dispute to the courts of Australia.
8.5. The Buyer consents to the jurisdiction of the courts of Australia in respect of any proceedings arising out of or in connection with these Terms or the purchase or use of the Products.
